The Federal High Court sitting in Osogbo, Osun State, on Monday, adjourned to November 27, 2025, the hearing of a suit filed by reinstated All Progressives Congress (APC) local government chairmen and councillors seeking judicial clarification on the legality of their tenure.
The suit, marked FHC/OS/CS/147/2025, was initiated by Onibonokuta Saheed and seven others against the Attorney-General of the Federation and six other defendants. The plaintiffs are asking the court to determine whether their three-year term officially began in February 2025, following their reinstatement by the Court of Appeal on February 10, 2025.
They are also challenging the legality of the local government elections conducted by Governor Ademola Adeleke’s administration on February 22, 2025, asserting that their tenure was still valid at the time the polls were held.
During Monday’s proceedings, the claimants’ counsel, Muhydeen Adeoye, filed a motion seeking an interim order to restrain the defendants from interfering with the officials’ duties, alleging that his clients were being hindered despite the appellate court’s ruling in their favour.
However, counsel for the 3rd and 4th defendants, F.K. Labo-Popoola, the 5th defendant’s counsel, Rachael Ojomi, and the 6th defendant’s counsel, J.A. Ayanyemi, argued that they were still within the legally permitted timeframe to respond to the originating summons. They requested more time to complete their filings.
Justice Adefunmilola Demi-Ajayi, presiding over the case, noted that not all parties had been properly served court documents. She ordered that proper service be effected on all respondents before the next hearing date to ensure due process and a fair hearing.
The judge reaffirmed the court’s commitment to a speedy resolution and adjourned the case to November 27, 2025.
